The Second Appellate District affirmed a judgment as modified. The court held that a trial court retained jurisdiction to reconvene a jury after having told the jurors they were dismissed, where the verdict was incomplete and the error was brought to the court’s attention before the jurors left the jury box.

Patricia Kimbell was charged with multiple felonies following a high speed chase in which two police officers were injured. It was further alleged that Kimbell had suffered one prior strike, two prior prison terms and three prior convictions for drunk driving. Trial on the priors was bifurcated from trial on the People’s case-in-chief.
