The Second Appellate District affirmed an order. The court held that a state agency did not abuse its discretion in listing a chemical as one known to cause reproductive toxicity under the Safe Drinking Water and Toxic Enforcement Act.

The National Toxicology Program (NTP), a federal interagency program that evaluated agents of public health concern, was part of the Center for the Evaluation of Risks to Human Reproduction (NTP-CERHR). NTP was also one of the agencies identified in regulations promulgated by the Office of Environmental Health Hazard Assessment (OEHHA) as authoritative bodies for purposes of identifying chemicals known to cause reproductive toxicity pursuant to Proposition 65, the Safe Drinking Water and Toxic Enforcement Act of 1986.
