The Sixth Appellate District affirmed a judgment. In the published portion of its opinion, the court held that the appellant’s three causes of action for breach of confidence, tortuous interference with contract and unfair competition were all based on an underlying claim of misappropriation of trade secrets and were thus preempted under California’s Uniform Trade Secrets Act.
K.C. Multimedia, Inc. (KCM) provided technology services for Bank of America Technology & Operations (BATO) and related entities. The business relationship disintegrated and KCM sued BATO for trade secret misappropriation, breach of confidence, tortious interference with contract, and unfair competition.
