In the published portion of its opinion, the court held that a trial court order denying sanctions for an alleged discovery violation was appealable as a collateral order even though it did not direct the payment of money or the performance of an act.
Manfred Muller injured his arm in a car accident. He was treated by Dr. Sanagaram Shantharam at Fresno Community Hospital & Medical Center (FCH). Some two weeks after the accident, Muller was transferred to UCLA Medical Center, where it was found necessary to amputate his arm below the elbow.
