SAN FRANCISCO — San Francisco attorney Philip Kay chiseled away Tuesday at the credibility of a San Diego judge who reported him to the State Bar for alleged misconduct, but his efforts might prove more beneficial to his co-defendant than himself.

On Monday, the State Bar Court judge presiding over Kay’s discipline trial issued a default order against himand imposed an issue sanction for his stated refusal to retake the stand and testify on April 28. The confusing order states that the charges against Kay are deemed admitted, though prosecutors will still need to prove them at trial.
