The court of appeals affirmed a judgment of the district court. The court held that an indictment charging an alien with illegal reentry supported enhancement of his sentence based on his aggravated felony conviction despite alleging only the date of his removal and not the relative date of his prior conviction.

Pedro Mendoza-Zaragoza was convicted of an aggravated felony and later removed. He was subsequently found in the U.S. and indicted under 8 U.S.C. §1326 as an alien in the U.S. after deportation.
