SACRAMENTO — If you can’t beat ‘em, cap their attorneys fees.

That, say critics of the Board of Equalization, appears to be the state tax agency’s approach after losing a $69,762 tax liability lawsuit last year. Not only is the board appealing the decision, but its members are now pursuing legislation that would limit awards of attorneys fees to $150 an hour in certain private AG lawsuits against the agency.
