The court of appeals held in abeyance a petition for review of an order of the Board of Immigration Appeals. The court held that there was a genuine factual dispute as to the identity of the father of one who claimed derivative citizenship, resolution of which would determine that question, and it was thus obliged to transfer his proceeding to district court for de novo determination of his nationality claim.
