Employment attorneys say Major League Baseball should be wary about how the league’s DNA testing program will fare against a new federal law restricting the use of genetic information in the workplace.

Surprised by the recent revelation that the MLB uses genetic testing to assess the ages of certain ball players, lawyers are doubtful that the league will be able to continue this practice — although they do offer some possible strategies for working around the Genetic Information Nondiscrimination Act. A key provision of GINA banning employers from acquiring or requesting genetic information from employees goes into effect Nov. 21.
