The court of appeals reversed a district court judgment. The court held that the exhaustion requirements of the Prison Litigation Reform Act do not apply to litigants who not incarcerated when they file suit.

Ruben Talamantes was incarcerated in a Los Angeles County jail from April until June, 2003. Talamantes, he later alleged, suffered indignities, mistreatment, and injury amounting to violations of his rights under the Eighth and Fourteenth amendments during the period of his incarceration. On August 16, 2004, he filed a 42 U.S.C. §1983 civil rights suit against the county, the sheriff’s department, numerous individuals.
