The Second Appellate District affirmed a judgment. In the published portion of its opinion, the court held that there was no prejudicial error in the admission of a sexual assault report through the testimony of a nurse practitioner other than the one who prepared the report.
Hugo Gutierrez was charged with multiple counts of kidnapping and forcible sex crimes. At Gutierrez’s jury trial, the prosecution alleged that Gutierrez accosted his unsuspecting victims as they walked or jogged through a public park, threatened them with a revolver and forced them to a secluded location where he performed or attempted to perform multiple forcible sex acts on them. Victims E.R., M.M., and K.M. testified to being attacked by Gutierrez. Each of them identified Gutierrez as the assailant. E.R. testified to multiple forcible sex acts, including rape.
