Fueled by a barrage of anti-lawyer TV ads, Proposition 64 sailed to a surprisingly easy victory, ushering in tight restrictions on the use of the state’s unfair competition law. A last-minute nudge from Gov. Arnold Schwarzenegger and a $13 million campaign likely helped to sway undecideds. Now a pitched battle appeared likely over whether it should apply retroactively. Plaintiff attorney Frank Pitre of Cotchett, Pitre, Simon & McCarthy said he did not expect courts to interpret the law that way. But, he added, lawyers might argue the point to prolong trials and postpone settlements.
Prosecutor Griffin Bonini coasted to victory in the runoff for Santa Clara County’s only open judicial seat. Bonini captured 60 percent of the vote to defeat Deputy Public Defender Enrique Colin, taking over the seat vacated when Judge Jerald Infantino retired.
