To change or not to change — lawyers, that is. That was the question faced by Mattel and MGA Entertainment as their epic battle over the Bratz dolls moved to the Ninth Circuit.

For MGA, which lost at trial, its decision to add new lawyers from Orrick, Herrington & Sutcliffe looks smart. Last Wednesday, the company won a major victory when it convinced the Ninth Circuit to put on hold a recall of the Bratz dolls that had been ordered last year by a Los Angeles district court judge. The appellate court’s brief order, which was issued on the same day as oral arguments, stays all other equitable relief that Mattel had won, and orders the two sides to try to settle their dispute through mediation. The court will likely issue a more detailed order later.
