The court held that a California prisoner who was subject to that state’s indeterminate timeliness rule was not entitled to tolling of the Antiterrorism and Effective Death Penalty Act’s limitations period for filing his federal petition for writ of habeas corpus.
Andrew Chaffer was a state prisoner in California. He unsuccessfully petitioned in state trial court for writ of habeas corpus. One hundred fifteen days after the trial court’s denial of his petition, Chaffer unsuccessfully petitioned the state appellate court. One hundred one days following the appellate court’s denial, Chaffer petitioned the state supreme court, which also denied his petition. Chaffer then petitioned for habeas relief.
