The Second Appellate District reversed an order and judgment granting an anti-SLAPP motion and vacated an order and judgment awarding attorney fees. The court held that a complaint seeking to invalidate a municipal bus stop maintenance contract with a competitor of the plaintiff and to compel the City of Pico Rivera to award the contract through competitive bidding was not subject to an anti-SLAPP motion by the city.
Graffiti Protective Coatings, Inc. (GPC) was awarded a municipal contract to maintain the bus stops in the City of Pico Rivera. Four years later, the city terminated the contract as permitted by its terms. Without inviting competitive bids, the city then entered into a new contract with National Environmental Services (NES), a competitor of GPC
