The Second District Court of Appeal ruled that Proposition 64, the November ballot measure restricting suits under California’s unfair competition law, was retroactive and applied to pending cases. The ruling came eight days after the First District had ruled just the opposite.

Boalt Hall students were protesting again — this time against the faculty member with the inside track to become the school’s dean. A letter addressed to UC-Berkeley chancellor Robert Berdahl criticized professor John Dwyer over his position on affirmative action. “We are convinced that professor John Dwyer has not shown commitment, concern or creativity in any of these areas or to Boalt Hall’s public mandate,” the letter stated. The letter was signed by, among others, the Boalt Hall Student Association, the Asian-Pacific American Law Students Association and the Berkeley Women’s Law Journal.
