The Second Appellate District affirmed in part and reversed in part a judgment. The court held that the trial court erred in relying on potentially conflicting issues of fact as the basis for denying class certification, rather than focusing on the common issues which supported class treatment.
Alex Jaimez worked as a route sales representative (RSR) for DAIOHS U.S.A., Inc., doing business as DAIOHS First Choice Services. First Choice sold and serviced a range of refreshment and other products to business customers, including gourmet coffees, brewing-related equipment, bottled water, water coolers, and vending machines. First Choice’s RSRs spent almost their entire workday on the road or at customers’ places of business. The only time spent onsite at First Choice was at the beginning and end of each shift.
