The California Supreme Court affirmed a judgment of conviction and affirmed in part and reversed in part a judgment of sentence, including sentence of death. The court held that a surviving victim’s prior employment with the district attorney’s office did not warrant the office’s recusal from a capital case.

Richard and Tammy Gamache, accompanied by Andre Ramnanan and another man, went to the home of Lee and Peggy Williams late one night to steal their horses. They woke the Williamses and tied them up. loaded the horses, and plundered the house, taking electronics, jewelry, cash and various other items. Using the Williamses’ truck and trailer, they then drove away with the horses and other belongings, taking the Williamses with them. They drove into the desert, where Richard ordered the couple out of the vehicle, shot both of them in the head and left them for dead.
