SACRAMENTO — The Ninth Circuit U.S. Court of Appeals ordered a new trial Monday for 23 women who say a Fresno company illegally fired them because of their limited fluency in English.

In an unpublished 2-1 ruling , the Ninth Circuit panel said the district court erroneously allowed attorneys for Nibco Inc., an Indiana-headquartered piping system manufacturer, to use peremptory challenges to boot three Hispanic jurors.
