The Sixth Appellate District affirmed a judgment. The court held that an attorney malpractice action alleging the mishandling of a patent application presented a substantial issue of federal patent law that had to be adjudicated in federal court.
Landmark Screens, LLC, sued attorney Thomas Kohler and the law firms with which he was associated for the mishandling of a patent application. Landmark alleged that Kohler not only mishandled the application, but also thereafter attempted to conceal his negligence, with the result that Landmark lost any opportunity it might have had to correct Kohler’s errors.
