A senior citizen who fractured a hip after tripping while walking to his car received a $400,000 settlement.

On Jan. 6, 2008, Kenneth Topping, then 81, tripped and fell over two elevated sidewalk panels on Vincente Street in San Francisco. Topping, who had to undergo surgery on his right hip, asserted that roots from trees planted in the subject sidewalk had pushed up and damaged approximately 26 panels. Counsel claimed that some of the elevations were as high as one inch and that other pedestrians had fallen at the same spot.
