The court held that an applicable regulation did not authorize an alien’s timely filed application for relief to be deemed abandoned for his failure to timely file supporting documentation.

Ramiro Casares-Castellon timely applied for relief. An immigration judge (IJ) ordered him to submit documents supporting his request. Casares-Castellon did not submit those documents within the time prescribed.
