The Fourth Appellate District reversed a judgment. The court held that a triable issue existed as to whether an assignee trucker under a transportation contract who was injured in the course of transporting contracted cargo was his assignor’s employee whose exclusive remedy was workers’ compensation.

Amerigas Propane, LP, contracted with motor carrier Landstar Ranger, Inc., to transport several propane tanks between two Amerigas facilities. Landstar assigned transportation of the load to King Transportation, Inc., as an independent contractor. Landstar leased a truck from Steven King, through King’s company, King Transportaion, LLC. While offloading the tanks at their destination, King was seriously injured.
