The court of appeals granted a petition for review of an order of the Board of Immigration Appeals. The court held that the death of a parent who was a U.S. citizen did not deprive an applicant of eligibility for a statutory waiver of removal which was available only to aliens who were the “spouse, parent, son, or daughter” of a U.S. citizen.

Rolando Federiso was a Filipino national. His mother, who was also a Filipino national, moved to the U.S. and became a U.S. citizen. Federiso later fraudulently obtained entry to the United States.
