The California Supreme Court reversed a decision of the court of appeal. The court held that the Attorney General was judicially estopped from challenging a district attorney’s October 2006 stipulation that a sex offender’s then-pending recommitments under the Sexually Violent Predators Act would be for two-year terms only.

In 1985, Javier Castillo was convicted of two counts of committing lewd acts upon a child under the age of 14 years by use of force, violence, or fear. He was sentenced to a six-year prison term. In 1992, he was convicted of a third count and was sentenced to an eight-year prison term.
