For nine years, death penalty defense lawyers have peppered the state Supreme Court with dozens of habeas corpus petitions containing minimal claims, but stopping the clock on the statute of limitations for any later federal claims.

Derisively called “shell petitions” by opponents, the filings routinely give habeas corpus counsel 36 more months to conduct investigations and to file a full set of claims.
