Satchell v. State

An officer testified that Satchell admitted she knew that her acquaintance was dealing narcotics, yet she allowed him to move into the apartment she had subleased, where the acquaintance then stored and sold PCP. OPINION

A jury found appellant, Shamika Yvonne Satchell, guilty of the offense of possession of Phencyclidine (“PCP”) weighing at least 400 grams by aggregate weight,*fn1 and the trial court assessed her punishment at confinement for 10 years, suspended the sentence, and placed appellant on community supervision for 10 years. In three points of error, appellant contends that the evidence is legally and factually insufficient to support her conviction and the trial court erred in instructing the jury that it could find appellant guilty of the offense of possession of PCP as a lesser-included offense of the offense of possession with intent to deliver PCP.*fn2

We affirm.
