The court of appeals granted in part and denied in part a petition for review of a decision of the Benefits Review Board and remanded. The court held that harmless error analysis applies to petitions for review brought under the Longshore and Harbor Workers’ Compensation Act. The court held further that an administrative law judge prejudicially erred in setting a benefits claimant’s date of maximum medical improvement at a date more than two years after the claimant suffered a stroke.

Leslie Ogawa worked for some 25 years as a maintenance clerk at a marine terminal in Honolulu operated by Hawaii Stevedores, Inc. Ogawa suffered from hypertension, and he regularly reported job-related stress to his physician.
