The California Supreme Court affirmed a court of appeal judgment. The court held that the trial court did not exceed its authority in ordering a defendant, as a condition of probation, to pay restitution directly to the hospital that provided the deceased crime victim’s medical care.
While driving late at night, Eli Anderson struck and fatally injured Robert Milligan, who was jaywalking. Unaware that he had struck a pedestrian, Anderson left the scene. Based on his actions, Anderson was later convicted of leaving the scene of an accident resulting in death. He was placed on felony probation pursuant to Penal Code §1203.1..
