The Second Appellate District reversed a judgment with directions. The court held that the Los Angeles City Employees Retirement System and the Judicial Retirement System lacked reciprocity provisions that would entitle a superior court judge who had formerly worked for the city to retire from the city retirement system at his higher judicial salary.

Abraham Khan worked for the City of Los Angeles in various capacities from approximately 1978 through 1988. At the end of that time, he was a Deputy City Attorney. Khan elected not to cash out his benefits with the Los Angeles City Employees Retirement System (LACERS).
