The Second Appellate District affirmed in part and reversed in part a judgment and remanded with instructions. The court held that a county could not be held liable for negligent failure to promptly serve a writ of execution that was issued on a judgment held by the father of a child for whose death a judgment debtor was responsible.

Bobby Ellerbee held a judgment against entertainer and rapper Todd Shaw that arose out of the death of Ellerbee’s son, for which Shaw was responsible. On June 18, 2007, the trial court issued a writ of execution to the sheriff of the County of Los Angeles.
