SAN FRANCISCO — The recession is pressing many lawyers to strike out on their own in hopes that lower rates and more flexibility will help them grow their practice, but it didn’t work out that way for patent lawyers Gerald Swiss and Lorna Tanner.

Last May, the duo left Foley & Lardner, where Swiss had been the Silicon Valley office managing partner, to open a three-lawyer patent prosecution and counseling boutique, citing rate pressures. A little more than a year later, they’re closing Swiss Tanner and returning to Foley. They rejoin Oct. 1 as partners, and bring with them an associate, two patent agents and a clerk.
