The court of appeals affirmed in part and dismissed in part orders of the district court. The court held that the government had no independent basis to retain seized drug-test results of professional athletes other than those of ten particular athletes who were specified in a search warrant.

A collective bargaining agreement between the Major League Baseball Players Association (players) and Major League Baseball provided for suspicionless drug testing of all players. Urine samples would be anonymously and confidentially collected and each would be tested for banned substances. If enough players tested positive, additional testing would be done.
