The Second Appellate District affirmed a judgment. The court held that the staying of a defendant’s sentence for a drug conviction did not bar use of that conviction as the basis for enhancing the defendant’s sentence for a subsequent drug offense.

A jury found Green Newton guilty of two counts of sale of a controlled substance, cocaine. In a bifurcated proceeding, the trial court found that Newton had suffered two prior drug convictions. The prior convictions were charged as enhancements under Health & Saf. Code §11370.2(a).
