SAN FRANCISCO — In the Bratz versus Barbie battle, the Ninth Circuit today tweaked its earlier opinion in a way the winning side says is the court’s preemptive strike at thwarting U.S. Supreme Court review.

In the amended opinion , the court says applying the “substantial similarity” test in deciding who owns the Bratz doll doesn’t create a circuit split.
