SAN FRANCISCO — A number of recent National Labor Relations Board decisions have management-side labor lawyers sitting on pins.
Earlier this month, the board sided with an employee who had been fired for criticizing her supervisor on Facebook, saying the law protected workers venting on social media sites just as it would disgruntled water cooler chatter. Late last month, the board ruled that interest on back pay should be compounded daily rather than quarterly or annually and that employers should notify workers of unfair labor practice cases electronically, not just on office bulletin boards.
