The Third Appellate District reversed a judgment. In the published portion of its opinion, the court held that a family court’s award of spousal support based on domestic violence in dissolution proceedings did not bar the obligee’s tort action against the obligor based on the same domestic violence.
Linda and Steven Boblitt married in 1989. In 2004, Linda filed for dissolution of the marriage. She sought spousal support, arguing that Steven’s physical abuse had resulted in injuries which impaired her ability to work.
