The Second Appellate District affirmed an order granting new trial, dismissed a cross-appeal, and remanded with instructions. The court held that a juror’s mid-trial statement that she had already made up her mind reflected prejudgment of the case, improperly influenced the verdict, and warranted a new trial.

Former City of Los Angeles police officer Mitchell Grobeson sued the city and commanding officer Daniel Watson for discrimination, retaliation and constructive discharge. Grobeson alleged that once his sexual orientation became known, he was discriminated against and ultimately was forced to leave the department.
