The Second Appellate District affirmed a judgment. The court held that where a private developer entered into an agreement with a municipality to accept public funding for required public facilities that were part of a development project, the entire project was thereby rendered subject to the prevailing wage law, and not merely that portion of the project paid for with public funds.
Developer Azusa Land Partners (ALP) undertook to construct a planned community known as the Rosedale project. The project was located in the City of Azusa. The city and ALP entered into a funding and acquisition agreement to provide for partial funding of required public facilities through Mello-Roos bonds.
