SAN FRANCISCO — A Second District Court of Appeal panel today kept alive a suit that contends Home Depot should pay civil penalties for failing to provide its California cashiers with a place to sit down on the job.
The plaintiffs in the case, suing under the Private Attorneys General Act, allege that Home Depot violates state statutes governing working conditions because it hasn’t provided seats to employees even though there is plenty of room behind the counters of its 100 California stores.
