The Second Appellate District reversed an order. The court held that it was not inequitable to add as a judgment debtor, on a judgment against companies in contract, an individual defendant in the same lawsuit who had placed those companies in trust and still managed them but was not sued in contract and had prevailed in arbitration on the claims on which he had been sued.
Barry Shy was a real estate developer who worked with Andrew Meieran to renovate the Higgins Building. Shy and Meieran formed LADT, LLC for that purpose. LADT was jointly owned by the Andrew Meieran Family Trust and Shy’s company, LABAR, LLC. Shy managed both LABAR and LADT.
