The Third Appellate District reversed a judgment in part and affirmed in part. The court held that challenged regulations adopted by the State Board of Education pursuant to Proposition 39 pertaining to a public school district’s sharing of its facilities with charter schools were valid.

Proposition 39 amended Educ. Code §47614 to require public school facilities to be shared fairly among all public school students, including those who attend charter schools. The section sets out charges that school districts may impose, and requires each charter school desiring facilities from a school district to provide an annual projection of average daily classroom attendance for the upcoming year. The section also requires the State Department of Education to propose, and allows the State Board of Education to adopt, regulations implementing the statutory requirements.
