The Third Appellate District affirmed a judgment. The court held that an employee who communicated with her attorney by email from her employer’s computer could not have a reasonable expectation of privacy in those emails; the emails were, accordingly not protected by attorney-client privilege.

Gina Holmes sent her attorney emails regarding a lawsuit she wanted to file against her employer, Paul Petrovich, and his company, Petrovich Development Company, LLC. Holmes sent the emails from her computer at work. Holmes later sued Petrovich for sexual harassment, wrongful termination and related causes of action.
