The court of appeals vacated an award of attorney fees and remanded the action for further proceedings. The court held that a district court erred in awarding attorneys fees to prevailing defendants in a civil rights case by making a pro-rata allocation of general fees between claims for which a fee award was appropriate and those for which an award was not appropriate, based solely on the number of claims.
Vernon Harris was appointed as an Initial Appearance Hearing Officer for the Maricopa County, Arizona, Superior Court. Based on allegations of improper conduct toward staff members and inadequate performance of his duties, Harris was placed on administrative leave a year later. He ultimately resigned after being given that option or the prospect of termination.
