The Fourth Appellate District affirmed as modified a judgment with directions. In the published portion of its opinion, the court held that imposition of separate and unstayed sentences on both firearm-use and great-bodily-injury enhancements on a defendant who was convicted of assault with a firearm violated Penal Code §654.
Amir Ahmed shot his girlfriend. According to her, the shooting occurred during an argument, shortly after Ahmed said, “Bitch, I’ll shoot you.” Ahmed testified that there was no argument and that the shooting was an accident that occurred as he was trying to unload the gun.
