A former client who turned the tables on a California law firm by citing a law often used in defending legal malpractice actions has lost a bid to strike the firm’s cross complaint.

The Fourth District Court of Appeal on Friday affirmed a lower court that ruled John Masten could not use the state’s anti-SLAPP law to stop Miller, King & James from pursuing a cross complaint in his legal malpractice lawsuit against the San Diego firm.
