The Sixth Appellate District affirmed a judgment. The court held that a state-agency requirement that the prevailing wage be paid in development for civilian use of land that was formerly a military base was properly applied to a downstream developer who acquired a parcel of that land.

Cypress Marina Heights LP (CMH) acquired land for its Marina Heights development project from the redevelopment agency of the City of Marina (MRDA). The land had been part of the former Fort Ord military base that MRDA had acquired from the Ford Ord Reuse Authority (FORA). FORA had been created by the Legislature to facilitate the transition of Fort Ord to civilian use.
