The Fifth Appellate District affirmed a judgment. The court held in the published portion of its opinion that a defendant’s detention and pat search were within the authority conferred on probation officers under California law where the defendant, as a casual visitor in a juvenile probationer’s home, appeared to be a belligerent and uncooperative gang member who was hiding an object on his person after officers entered the home pursuant to a warrantless search condition.

Along with five other probation officers, Kern County Deputy Probation Officer Terry Michael Morris went to a residence in Rosamond, where a juvenile probationer resided. Previously, during a home visit by officers several weeks earlier, the juvenile admitted being under the influence of drugs, and the officers saw gang tagging in the house.
