The Fourth Appellate District reversed a judgment. The court held that an original complaint’s lack of specificity did not preclude a finding that a subsequent amended complaint “related back” to the earlier filed complaint.
In 1998, Pointe San Diego Residential Community, L.P., (Pointe Residential) and others filed two lawsuits relating to disputes over the development of certain residential property. They retained the law firm of Procopio, Cory, Hargreaves & Savitch, LLP to represent them. In 2002, with litigation still ongoing, one of the three plaintiffs, Pointe SDMU, L.P., retained a second attorney, Michael Vivoli, to serve as its cocounsel. In February 2003, Vivoli became cocounsel for all three plaintiffs.
