The Second Appellate District affirmed an order. The court held that a beneficiary of a trust who had not agreed to arbitrate disputes that arose under the trust could not be compelled to do so.

Daniel and Marie Diaz established a family trust. Subsequently, Marie Bukey was appointed successor trustee of the trust. Bukey and Paulette Diaz were sisters and beneficiaries of the trust. The trust became irrevocable upon the death of the surviving settlor. Diaz made a written request of Bukey for an accounting of Bukey’s tenure as trustee. The accounting that Bukey provided was not satisfactory to Diaz.
